How much liability insurance should I carry?

Nebraska law and the law of most states require a minimum requirement of liability insurance. Nebraska has a $25,000 minimum limit on liability insurance that you must carry before you can get you car licensed. Liability insurance coverage is insurance that pays a third party that is injured because of your own negligent conduct. We think $25,000 is far too low. Many of our clients who were sexually abused as children do not recall the abuse until much later in adult life. This is often referred to as “repressed memory” or dissociative amnesia. Clients who have this condition are frequently abused as children by a close family member, close friend, or person in authority for a long period of time. The trauma is so significant that the memory is placed in a small corner of the mind and not recalled until later in life. When the memories begin to appear, oftentimes in the late-twenties or early- thirties, the individuals often begin to understand what has been happening in their all along. You need to know that mental health professionals are sharply divided as to whether there is such a thing as repressed memory.

If you file a lawsuit, sooner or later the opposing attorney is going to want to take your deposition. A deposition is part of the rules which give all parties the right to discover the facts, and is basically a question and answer session under oath before a Court Reporter, which is then transcribed. Depositions these days are also frequently video-taped. Your lawyer and the lawyer for the other party are present during the deposition, and the other lawyer will ask you a series of questions concerning your case. Your deposition is the most important part of your case. The testimony you give in a deposition can be and usually is used in the trial of your lawsuit. Your lawyer will spend time with you before the deposition in order to help you prepare.
